APRIL 2, 2011: TRADEMARK LAW AND BRANDING FOR MUSICIANS
With Richard B. Jefferson, Esq.

Trademarks and branding have become integral to many musical artists'
professional identities--for example BEYONCÉ owns multiple registered
trademarks for recorded music, clothing, perfume, posters, handheld
mobile devices, and other consumer products. We'll discuss the basics of
trademark law, such as: differences between copyrights and trademarks;
different levels of protection (common law, intent-to-use, supplemental,
principal registration); the registration process; and legal strategies
(i.e.,opposing or canceling an improper trademark, fair use). Time
permitting, we'll tackle topics like: trademarks and how they relate to
social media (Facebook, Twitter, Youtube, etc.); branding and licensing
strategies; domain name uses and disputes; and issues relating to
performance rights organizations (ASCAP, BMI, SESAC), record labels,
and/or publishing companies.

APRIL16, 2011: COMPOSER AND MUSIC LICENSING AGREEMENTS FOR FILM, TV, &
NEW MEDIA

With Gordon P. Firemark, Esq.

This workshop will provide a brief overview of the current film and
television music landscape, particularly in an era of shrinking budgets
and fragmented audiences. We'll navigate typical composing and licensing
agreements, shed light on strategies for negotiating the best possible
deal, and highlight the most common pitfalls.You'll learn: copyright law
fundamentals for composers and songwriters; terms and conditions of a
typical film composer deal; how to retain ownership of your music when
dealing with independent filmmakers; when to say "no" to a "work made
for hire "provision; terms of typical Master Use and Synchronization
License Agreements; and how to make sure you get your PRO royalties.

APRIL 30, 2011: MUSICAL ARTIST MANAGER AND BOOKING AGENT AGREEMENTS

When is the right time for a musical artist or band to start working
witha manager and/or booking agent (and vice versa)? What are the
differences between a manager and a booking agent? How does a musical
artist or band find a manager and/or agent (and vice versa)? What type
of agreements/terms apply? This workshop will discuss the basic
contractual provisions, industry standards, and more.
